Introduction

Yush Ltd ("we," "us," "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, and share your personal data when you use our services.

Information We Collect

We collect several different types of information for various purposes to provide and improve our Service to you.

  • Account Data: Name, email address, business details (for business users).
  • Feedback Data: User reactions (e.g., emojis, GIFs, photos) submitted through Yush.
  • Device Data: IP address, browser type, and usage data for analytics.

We do not collect sensitive personal data. Where we need to collect Personal Data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you. In this case, we may have to cancel the account you have with us but we will notify you if this is the case at the time.

How We Use Your Information

We process your data for:

  • Providing and improving our services.
  • Displaying feedback in real time.
  • Ensuring security and preventing fraud.
  • Analyzing user engagement and trends.
  • Sending service-related updates and communications.

If you submit feedback, that feedback may automatically be published on our Service including any Personal Data contained in that review. You can control what Personal Data (if any) is published in respect of any reviews submitted by you, and delete or amend a submitted feedback, by logging into your user profile on our Service.

We will only use your Personal Data when the law allows us to. Most commonly, we will use your Personal Data in the following circumstances:

  • Performance of Contract. This means processing Personal Data where it is necessary for compliance with a legal obligation that we are subject to.
  • Legitimate Interest. This means processing your Personal Data where it is necessary for the legitimate interests of our business (or those of a third party) in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your Personal Data for our legitimate interests. We do not use your Personal Data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law).   • Comply with a legal obligation. This means processing your Personal Data where it is necessary for compliance with a legal obligation that we are subject to.

Sharing Your Information

We may employ third party companies and individuals to facilitate our Service ("Service Providers"), to provide the Service on our behalf, to perform Service-related services or to assist us in analysing how our Service is used.

These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

  • Google Analytics: Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. You can opt-out of having made your activity on the Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity.   • HotJar: Hotjar allows to make the behavior of web and mobile site visitors visible. To opt out of Hotjar please go to the following link: https://www.hotjar.com/policies/do-not-track/ Hotjar also honors the Do Not Track header. This means that if you have the Do Not Track header installed, Hotjar will not track you
  • Facebook Pixel: The Facebook pixel is an analytics tool offered by Facebook that measures the effectiveness of advertising by understanding the actions people take on a website. You can manage the activity tracked by Facebook pixel in your settings: https://www.facebook.com/off_facebook_activity. This includes viewing and clearing existing activity, as well as opting out of tracking future activity from businesses and organisations which you visit outside of Facebook, including activity on Yush and partner websites.   • Business clients (who use feedback for internal analysis, marketing, or customer service).
  • Legal authorities (if required by law or necessary for fraud prevention).

Data Retention

We will only retain your Personal Data for as long as reasonably necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your Personal Data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for Personal Data, we consider the amount, nature and sensitivity of the Personal Data, the potential risk of harm from unauthorised use or disclosure of your Personal Data, the purposes for which we process your Personal Data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

Notwithstanding the above, by law we have to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for six years after they cease being customers for tax purposes. In some circumstances you can ask us to delete your data (see Your legal rights below for further information) or we will anonymise your Personal Data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

Data Security

The security of your data is important to us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

Disclosure Of Data

We may share your Personal Data with the parties set out below.

We require all third parties to respect the security of your Personal Data and to treat it in accordance with the law. We do not allow our third-party service providers to use your Personal Data for their own purposes and only permit them to process your Personal Data for specified purposes and in accordance with our instructions.

  • Business Transaction. If Yush Ltd is involved in a merger, acquisition or asset sale, your Personal Data may be transferred. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your Personal Data in the same way as set out in this privacy policy. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.
  • Disclosure to Law Enforcement. Under certain circumstances, Yush Ltd may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).
  • Legal Requirements. Yush Ltd may disclose your Personal Data in the good faith belief that such action is necessary to:
    • To comply with a legal obligation
    • To protect and defend the rights or property of Yush Ltd
    • To prevent or investigate possible wrongdoing in connection with the Service
    • To protect the personal safety of users of the Service or the public
    • To protect against legal liability

In particular, we may disclose Personal Data to HM Revenue & Customs, regulators and other authorities acting as processors or joint controllers based in the United Kingdom or United States who require reporting of processing activities in certain circumstances.

Payments

We may provide paid products and/or services within the Service. In the case that the payment is not collected directly via your ecommerce platform, we use third-party services for payment processing (e.g. payment processors). We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

If you are in the UK or EU, you have rights under GDPR, including:

Children’s Privacy

Our Service does not address anyone under the age of 13 ("Children").

If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

Changes to This Policy

We will only use your Personal Data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.

If we need to use your Personal Data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.
